These Terms and Conditions set out the basis on which Rubbish Clearance Streatham provides waste removal and related services to domestic and commercial customers. By booking a collection or using any of our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions:

Company means Rubbish Clearance Streatham.

Customer means the person or organisation that requests and/or pays for the services.

Services means rubbish clearance, waste collection, removal, loading, transportation, and associated activities carried out by the Company.

Site means the property, premises, or location from which the waste is to be collected.

Waste means any rubbish, junk, household items, garden waste, commercial waste, building waste, or other materials agreed to be removed.

2. Scope of Services

The Company provides waste collection and rubbish clearance services, including but not limited to domestic rubbish removal, commercial waste removal, garden waste clearance, bulky item removal, and light construction waste clearance. All services are subject to the terms set out in this document and to applicable UK waste management and environmental regulations.

The Company is not responsible for any additional services that have not been expressly agreed in writing or confirmed during the booking process. Any changes to the agreed services may result in additional charges.

3. Booking Process

3.1 Bookings may be made by telephone, email, or through any booking system operated by the Company. By placing a booking, the Customer confirms that they have the authority to do so and that all information provided is accurate and complete.

3.2 When you make a booking, the Company will provide an estimated price based on the information given regarding the type, volume, and location of the waste, as well as access to the Site. This estimate may be confirmed on arrival once the team has inspected the waste and assessed the work required.

3.3 The booking is considered accepted, and a contract formed, when the Company confirms the booking details and, if required, receives any applicable deposit or pre-payment from the Customer.

3.4 The Customer must inform the Company at the time of booking of any relevant Site conditions, including limited access, parking restrictions, stairs, long carry distances, or any items requiring special handling.

4. Estimates and Pricing

4.1 All prices are quoted in pounds sterling and are exclusive of any applicable VAT unless stated otherwise.

4.2 Prices are generally based on the volume and type of waste, labour required, and disposal costs. The Company reserves the right to adjust the final price if the actual waste or job conditions differ from what was described at the time of booking.

4.3 Any estimate given before the team attends the Site is an approximation only and is not binding. The final price will be confirmed before work begins, after the team has inspected the waste and any Site conditions.

4.4 If the Customer does not agree to the revised price, they may decline the service before any work begins and will not be charged, except for any agreed call-out or attendance fee where applicable.

5. Payments

5.1 Payment is due on completion of the service on the date of collection, unless otherwise agreed in writing before the service is carried out.

5.2 The Company accepts common UK payment methods, which may include cash, debit card, credit card, or bank transfer. The available payment methods will be confirmed at the time of booking.

5.3 For commercial Customers or larger projects, the Company may require a deposit or full pre-payment before attending the Site.

5.4 Where payment terms have been agreed, invoices are payable within the agreed period from the invoice date. The Company reserves the right to charge interest on late payments at the statutory rate and may suspend further services until outstanding sums are paid in full.

5.5 The Customer is responsible for all charges associated with their chosen payment method, including any bank or card processing fees applied by third-party providers.

6. Cancellations and Amendments

6.1 The Customer may cancel or amend a booking by contacting the Company within the hours of operation, using the contact details provided at the time of booking.

6.2 If the Customer cancels more than 24 hours before the scheduled collection time, no cancellation fee will normally be charged, unless otherwise agreed at the time of booking.

6.3 If the Customer cancels within 24 hours of the scheduled collection time, the Company reserves the right to charge a cancellation fee to cover administrative and operational costs. This fee will not exceed a reasonable proportion of the quoted service charge.

6.4 If the team arrives at the Site at the agreed time and is unable to complete the collection due to reasons within the Customer's control, such as lack of access, incorrect information, or the Customer not being present where required, the Company may charge a wasted journey fee.

6.5 The Company reserves the right to cancel or reschedule a booking due to circumstances beyond its reasonable control, including but not limited to severe weather, vehicle breakdown, staff illness, or safety concerns. In such cases, the Company will notify the Customer as soon as reasonably possible and will seek to arrange an alternative time.

7. Customer Obligations

7.1 The Customer must ensure safe and reasonable access to the Site and to the Waste to be collected. This includes arranging suitable parking where needed, ensuring gates and doors are unlocked, and providing clear passage to the Waste.

7.2 The Customer must ensure that the Waste presented for collection matches the description provided at the time of booking, including the type, approximate volume, and any heavy or awkward items.

7.3 The Customer must not present for collection any materials that are hazardous, restricted, or prohibited by law, except where the Company has expressly agreed in advance to handle such materials.

7.4 The Customer is responsible for obtaining any necessary permissions for access, such as from landlords, neighbours, building managers, or local authorities.

7.5 The Customer must not request the team to undertake any illegal or unsafe activities, including unlawful tipping, disposal without the proper licence, or entry into areas that pose unacceptable risk.

8. Waste Types and Regulations

8.1 The Company operates in accordance with applicable UK waste management and environmental regulations. All Waste will be transported and disposed of or recycled through authorised facilities and in line with relevant legislation.

8.2 The Company is unable to collect certain hazardous or specialist wastes without prior agreement. Such items may include asbestos, clinical or medical waste, chemicals, solvents, oil, gas bottles, certain electrical items, and other regulated materials.

8.3 The Customer must declare any potentially hazardous or unusual items at the time of booking. If such items are discovered on arrival and have not been declared, the Company may refuse to take them, adjust the price accordingly, or decline the service.

8.4 The Company may issue a waste transfer note or similar documentation where required by law. The Customer agrees to provide reasonable information to complete such documentation accurately.

8.5 Once the Waste has been loaded onto the Company's vehicle and payment has been made, title and responsibility for the Waste transfers to the Company. Prior to loading, the Waste remains the responsibility of the Customer.

9. Service Limitations and Access

9.1 The Company's ability to complete the service depends on practical access to the Site and the Waste. If access is restricted or dangerous, the team may decide not to proceed with all or part of the work.

9.2 The Company will use reasonable care to avoid damage when carrying Waste through buildings, gardens, or communal areas. However, the Customer should make reasonable arrangements to protect floors, walls, doorways, and other surfaces if they are concerned about possible scuffs or marks.

9.3 The Company is not responsible for clearing Waste that is not expressly included in the agreed service, nor for any property left inside items designated for removal unless such contents are specifically identified and removed by the Customer beforehand.

10. Liability and Insurance

10.1 The Company will perform the Services with reasonable skill and care. If the Customer believes that the Services have not been provided to a reasonable standard, they must notify the Company as soon as possible and in any event within 7 days of the service date.

10.2 The Company's total liability for any loss or damage arising out of or in connection with the Services, whether in contract, tort, or otherwise, shall be limited to the amount paid or payable by the Customer for the relevant service, except where such limitation is not permitted by law.

10.3 The Company is not liable for any indirect, consequential, or economic losses, including loss of profits, loss of business, loss of opportunity, or loss of data.

10.4 Nothing in these Terms and Conditions excludes or limits the Company's liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law.

10.5 The Company maintains appropriate insurance cover for its vehicles and operations in line with legal requirements and industry practice.

11. Complaints and Disputes

11.1 If the Customer has any concerns or complaints regarding the Services, they should contact the Company promptly using the contact details provided in their booking confirmation or invoice.

11.2 The Company will investigate any complaint in a fair and timely manner and will aim to resolve the matter directly with the Customer wherever possible.

11.3 If a dispute cannot be resolved amicably, the parties may consider mediation or other forms of alternative dispute resolution before commencing formal legal proceedings.

12. Data Protection and Privacy

12.1 The Company will collect and process personal data only as necessary to provide the Services, administer bookings, and comply with legal obligations.

12.2 The Customer consents to the Company using their contact details for service-related communication, including booking confirmations, service updates, and invoicing.

12.3 The Company will take reasonable steps to keep personal data secure and will not sell or disclose such data to unrelated third parties, except where required by law or where necessary to deliver the Services.

13. Force Majeure

13.1 The Company shall not be liable for any delay in performing, or failure to perform, any of its obligations under these Terms and Conditions if such delay or failure results from events, circumstances, or causes beyond its reasonable control.

13.2 In such circumstances, the Company will use reasonable efforts to minimise any disruption and, where possible, will agree a new service date with the Customer.

14. Variations to Terms

14.1 The Company reserves the right to update or amend these Terms and Conditions from time to time. Any revised terms will apply to bookings made after the date on which the revisions take effect.

14.2 For ongoing or long-term arrangements, the Company will notify the Customer of any material changes to these Terms and Conditions where reasonably practicable.

15. Severability

15.1 If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court or other competent authority, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable. If such modification is not possible, the relevant provision shall be deemed deleted.

15.2 Any such modification or deletion shall not affect the validity and enforceability of the remaining provisions.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

16.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter, save that the Company retains the right to bring proceedings against the Customer in any other court of competent jurisdiction.
